An update to the ongoing Working Time Directive sleep-in cases currently being progressed by NIPSA’s solicitors McCartan Turkington Breen (MTB).
MTB have reported that in relation to a planned Case Management Preliminary Hearing listed for the 14.2.23 they have been advised:
“the OIT/FET adjourned the CMPH because the President was unavailable. The likely re-listing date (TBC) is going to be 30/3/23 due to availability issues of Counsel.
I will update you in April 2023 but this likely means the proposed 5 days – 15/5/23 will require to be re-listed.”
NIPSA would again advise that if members have for whatever reason stopped doing sleep-ins as part of their normal working arrangements, or will not be doing sleep-ins for a period in excess of 3 months, then they need to advise NIPSA as a matter of priority as proceedings would have to be lodged on a protective basis on their behalf. It is your responsibility to confirm your current position if and when you have stopped doing sleep-ins and why.
